BSU Hosts Forum on Regulatory Takings in Oregon, Idaho

The Boise State University Public Policy Center and Institute for Urban and Regional Planning will host a public forum on the implementation of Measure 37 in Oregon and the likely impacts of Idaho’s Proposition 2. The forum, scheduled for 7 p.m. Sept. 27 in the Student Union Lookout Room, is free and open to the public. The event is co-sponsored by the Association of Idaho Cities and the Idaho Association of Counties.

Proposition 2 is an initiative measure that will appear on the Idaho ballot this November. Titled “Initiative limiting eminent domain when used for economic development; Defining land use law; and Permitting just compensation for regulatory takings,” Proposition 2 could result in major changes in Idaho land use law, especially in the area of regulatory takings.

The keynote speaker will be Sheila Martin, director of the Portland State University Institute of Portland Metropolitan Studies. The PSU institute has a database of all claims brought under Measure 37. Martin will speak about the impact of the measure on Oregon and its land use law framework. A panel consisting of Jerry Mason from the Association of Idaho Cities, Harlan Levy from the Oregon Association of Realtors, and JoAnn Butler from Spink Butler Law Offices will respond to Martin’s comments and place them in an Idaho context.
